2. Scope and acceptance
These Terms apply to any use of the site and to every order placed through it. Binding acceptance of these Terms takes place through explicit confirmation upon registration and at checkout. Using the site also implies that you have read these Terms. If you do not agree with them, please do not use the site.
3. Registration and user account
Browsing the site and adding products to the cart are possible without registration. To complete an order, you need to log in or register an account. You are responsible for the accuracy of the data you enter and for keeping your account credentials safe. Please notify us if you suspect unauthorized access.
4. Products and information
The store offers new as well as used and refurbished electronic devices. For every used or refurbished product, its condition (grade) is stated in the listing description. The stated condition and natural wear are not considered defects. Used and refurbished devices are tested before sale. We strive to keep product information accurate and up to date, but it may contain technical inaccuracies or errors, which we correct as soon as we identify them.
5. Prices
Prices on the site include VAT at the rate of 20%. The delivery price is shown separately and is calculated at checkout. The minimum order value is 39.99 €. The Seller reserves the right to change prices at any time, and such changes do not affect already confirmed orders.
6. Conclusion of the contract
The products presented on the site are an invitation to place an order, not a binding offer. An order is placed by adding products to the cart and confirming the order after entering delivery and payment details. After you submit the order, you receive a confirmation by email. The sales contract is considered concluded from the moment the Seller confirms the order (by email or phone). Ownership of the goods passes to the Customer after full payment of the price.
The Seller has the right to decline or cancel an order in cases of stock unavailability, an obvious error in price or description, or confirmed fraud indicators, as well as in other cases at its discretion, by notifying you and refunding any amounts already paid.
7. Payment
We offer payment by bank card, cash on delivery, bank transfer and purchase in installments. The details of each method, the applicable fees and conditions are described on the "Payment Methods" page. We do not store full bank card details; card payments are processed by a licensed payment service provider.
Installment purchase is provided by DSK Bank ("Banka DSK" AD). ITOPIA EOOD acts solely as a credit intermediary presenting the bank's financing offer and does not charge the customer any fee for this intermediation.
8. Delivery
Delivery is carried out by courier or by pick-up from the warehouse. The methods, timeframes and prices for delivery are described on the "Shipping Policy" page. The risk of loss or damage passes to the Customer at the moment the goods are received. We recommend that you inspect the parcel on receipt and report any visible transport damage immediately. In case of an unjustified refusal to accept a delivered order, outside the statutory right of withdrawal, the costs of delivery and return are borne by the Customer.
9. Right of withdrawal and returns
As a consumer, you have the right to withdraw from a distance contract within 14 days, without giving a reason, in accordance with the Consumer Protection Act. The conditions, timeframes and procedure for returns and refunds, including the standard withdrawal form, are described on the "Return and Refund Policy" page.
10. Warranty and claims
The goods sold come with a warranty card and are subject to warranty service in accordance with the stated "Warranty Terms". Regardless of the commercial warranty, if the goods do not conform to the contract you have the right to file a claim under the Consumer Protection Act. The statutory guarantee of conformity is 2 years for new goods, while for used goods the parties may agree a shorter period, but not less than 1 year. The commercial warranty, for example a one-month warranty on the battery of used devices, is additional and does not limit your statutory rights. A claim is submitted to the Seller with a description of the non-conformity and proof of purchase attached.
11. Customer obligations
The Customer undertakes to use the site in good faith and for its intended purpose, to provide accurate data, and not to take actions that breach the law or the rights of third parties, endanger the security of the site or interfere with its normal operation.
12. Reviews and user content
Registered users may post reviews and ratings for products and for the store. Every review is moderated before publication. At present we do not carry out an automatic check of whether the review's author purchased the specific product. The content must be truthful and must not contain insults, false information or materials that breach the law. The Seller has the right not to publish or to remove content that does not meet these requirements.
13. Intellectual property
The content of the site, including texts, images, logo and design, is protected and may not be used without the consent of the Seller or the respective rights holder.
14. Limitation of liability
The Seller is not liable for damages arising from improper use of the purchased products, from the content of external sites linked to, or from temporary unavailability of the site due to technical reasons or circumstances beyond its control. These limitations do not apply, and liability is not excluded, in cases of harm to life and health, or of intent or gross negligence on the part of the Seller. This clause does not limit consumer rights under the mandatory provisions of the law.
15. Personal data
We process your personal data in accordance with the General Data Protection Regulation (GDPR) and the Personal Data Protection Act. Detailed information on the purposes and legal grounds for processing, as well as on your rights, is available in the "Privacy Policy".
16. Amendments to the Terms
The Seller has the right to update these Terms. The current version is always published on this page. We notify registered users of material changes (by email or on login), and you may choose not to accept the changes and to close your registration. Already confirmed orders are governed by the terms in force at the time of the order.
17. Dispute resolution
We aim to resolve any dispute amicably and in dialogue with the Customer. In case of a dispute, you may contact the Commission for Consumer Protection (CCP): Sofia 1000, 4A Slaveykov Sq., tel. 0700 111 22, website kzp.bg.
